About these terms
These terms apply to every order for phones, SIM plans and website services placed with Gtek Ltd, and to your use of this website and the trade portal. Placing an order means you accept them.
Who we sell to
Gtek sells to businesses only: limited companies, sole traders, partnerships and other trading businesses. We do not sell to consumers.
Business use only
When you open a trade account and each time you place an order, you confirm that:
- you are acting for the purposes of your trade, business, craft or profession, and not as a consumer;
- everything you order is bought solely for use in that business (including supplying it to your staff for work) or for resale, and not for your own or anyone else's personal or household use; and
- you have authority to place orders for the business named on your account.
We rely on these confirmations when accepting your order and setting our prices. We keep a record of each confirmation with the order. We may refuse or cancel an order, or close an account, if we reasonably believe goods are being bought for personal use.
Because these are business-to-business sales, laws that apply only to consumer purchases, such as the Consumer Rights Act 2015 and the 14-day cancellation right for consumers, do not apply. If you have given us an incorrect confirmation, you are responsible for any losses this causes us.
Trade accounts
Trade accounts are opened at our discretion. Keep your login details private. You're responsible for orders placed through your account. Tell us straight away at info@gtekdirect.com if you think someone else has used it. We may suspend an account that is misused.
Prices and VAT
Prices are shown excluding VAT, which is added at the current rate on your invoice. SIM plan prices are monthly. Prices can change without notice. The price that applies is the one shown when we confirm your order.
Stock and order confirmation
An order is accepted only when we confirm it by email. If we can't supply an item at the price or quantity ordered, we'll contact you to cancel or adjust that line. We'll never swap in a different product or charge a different price without your agreement.
Payment
When we confirm your order, we send a pro-forma invoice. Payment is due by bank transfer before dispatch, using your order reference. Our bank details appear on our invoices and will never change by email; if you receive a message saying they have, call us before paying. Goods remain Gtek's property until paid for in full.
Delivery
We confirm any delivery charge and the expected delivery date when we confirm your order, before you pay. Delivery dates are estimates. Risk passes to you on delivery. Please check deliveries on arrival and report any damage or missing items within 48 hours.
Product condition and sourcing
Unless the product listing says otherwise, all phones are genuine, brand new and unused. Some models may come from the manufacturer's European stock that has been set up for use in the UK, so packaging, inserts or labels can differ from UK retail versions. Every new phone is covered by a manufacturer warranty valid in the UK.
Products listed as refurbished, pre-owned or open box are not new. Their condition and warranty are shown on the listing. They may not be covered by a manufacturer warranty; where they aren't, any warranty is provided by us, or on our behalf, for the period stated on the listing.
Faulty or incorrect goods
New phones are covered by the manufacturer's warranty. Refurbished or pre-owned items are covered by the warranty stated on their listing. If an item arrives faulty or isn't what you ordered, contact us within 14 days of delivery at info@gtekdirect.com with your order reference. We'll arrange the return and then repair, replace or refund the item. Returned items must include all accessories and packaging.
SIM plans
SIM plans are supplied on the network's terms for the stated contract length. Ending a plan early may mean early-termination charges from the network.
Website services
Website projects follow the quote you accept, which sets out the price, what's included and any monthly hosting and care fee. Once paid for, you own your content and domain name. Monthly services can be cancelled with 30 days' notice.
Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited by law. Otherwise, we aren't liable for indirect losses such as loss of profit, business or data. Our total liability for any order is limited to the price paid for that order.
Using this website
Product names and brands belong to their owners and are used only to identify the products we supply. Don't misuse the site, the trade portal or other users' accounts.
Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
